Your rights in Canada

Being LGBTQ+ is legal

Same-sex relationships are legal everywhere in Canada. Same-sex marriage has been legal across the country since 2005.

Discrimination is against the law

Landlords, employers, schools and services cannot treat you badly because of your sexual orientation, gender identity or gender expression.

Trans and non-binary people

Gender identity is protected by law. Ontario ID offers an "X" gender option, and OHIP covers some gender-affirming care.

Hate is a crime

Threats or violence because of who you are can be reported to police as a hate crime. We can go with you.

Refugee claims based on who you are

Canada accepts refugee claims from people who face persecution because of their sexual orientation, gender identity or expression. The Immigration and Refugee Board has special guidelines for these claims.

  • You do not need to have been "out", had a partner, or know other LGBTQ+ people to make a claim
  • It is understood that many people hid who they are to stay safe; that does not hurt your claim
  • Tell your lawyer as early as possible, even if it feels hard; share details only when you are ready
  • If you are uncomfortable with your interpreter, you can say so and ask for another one.

Your privacy and safety

  • You decide who knows — you never have to come out to get help from Sauti Yetu or any service
  • People from your home community may also live here; be careful what you share in large WhatsApp or Facebook groups
  • We never record your sexuality or gender identity unless you ask us to
  • Our LGBTQ+ support group is invitation only; members are checked by our team
  • Use the Quick exit button at the top of this page if someone walks in.
